Terms of Service

Agreement to these terms
These Terms of Service ("Terms") are a contract between you and IRAPilot ("IRAPilot", "we", "us") governing your access to and use of www.irapilot.com and the IRAPilot service. By creating an account, downloading documents prepared through the service, or otherwise using the service, you agree to these Terms. If you are agreeing on behalf of a business, you represent that you are authorized to bind that business.
What IRAPilot does, and does not do
IRAPilot provides software that helps a business set up and run a SIMPLE IRA plan: preparing a filled Fidelity adoption packet you print, sign, and mail yourself, preparing employee notices and enrollment instructions, tracking deadlines and sending reminders, and keeping plan records.
IRAPilot is not a bank, custodian, broker-dealer, or investment adviser. We do not hold customer funds, and we do not provide investment, legal, or tax advice. Employee accounts are held at an independent, IRS-approved custodian. Decisions about whether a plan is right for your business, and how participants invest, are yours to make, with your own advisers.
Your responsibilities
You agree to provide accurate business and participant information and to keep it current. As the plan sponsor, you remain legally responsible for your plan's obligations, including timely funding of contributions, eligibility determinations, and delivery of required notices. IRAPilot prepares documents and reminders only, and does not perform these obligations for you.
You are responsible for the accuracy of the business and payroll information you enter into the service, for maintaining the security of your account credentials, and for using the service in compliance with applicable law.
Cost of the service
IRAPilot's service is free of charge. We do not charge you a subscription, a monthly fee, a per-employee fee, or a setup fee. Your relationship with the account custodian, including custody of plan assets, is governed by the custodian's own agreements with you and your employees, and IRAPilot is not a party to those agreements.
SECURE 2.0 tax credits, where you qualify, are claimed on your own federal tax return and are not a discount applied by IRAPilot. We do not guarantee any tax outcome.
Third-party services
The service relies on third parties, including the account custodian. Your use of those services is governed by their own agreements, and IRAPilot is not responsible for their acts or omissions.
Disclaimers
The service is provided on an 'as is' and 'as available' basis. To the fullest extent permitted by law, IRAPilot disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or that it will meet every regulatory requirement applicable to your specific circumstances.
Limitation of liability
To the fullest extent permitted by law, IRAPilot and its officers, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or lost savings. Because the service is provided free of charge, and to the fullest extent permitted by law, our total liability for any claim arising out of or relating to the service is limited to one hundred U.S. dollars ($100).
Termination
You may stop using the service and close your account at any time. We may suspend or terminate access for breach of these Terms or as required by law. Certain plan and participant records must be retained after termination to satisfy IRS and Department of Labor requirements, as described in our Privacy Policy.
Changes to these terms
We may update these Terms. When changes are material, we will update the effective date above and notify account holders before the changes take effect. Continued use of the service after that date means the updated Terms apply.
